Section 21: Additional terms & conditions ( as of 1-4-2025)

Please refer to Addidional Sections which will be termed as SUB-section of Section 21 all or part thereof:

SUB-Section 1 (Warranty and service)
* The product supplied by us will be only considered in Warranty only and only if it is mentioned in Invoice as a separate entity. And Such Warranty will be exclusively 
limited to standard warranty for the period of 12 months from the date of purchase of product, and is limited only for all or part of product described in Invoice (not
including exclusions described under). No third party product or attachment on which the operation of product is based up on is eligible to be covered under warranty.
The customer is directed to refer warranty conditions of these third party products for their reference.
* Subject to Gwalior jurisdiction only.
* Goods once sold will not be taken back in any Circumstances.

SUB-Section 2 (Customer responsibilities)
* The Customer shall operate the product as defined in the instruction manual and perform maintenance according to company's maintenance schedule.
* Use of Genuine parts and lubricants is mandatory, failure to do so, Company reserves the right to forfeit Warranty for the said product without any notice.
* It is duty of Customer to avail necessary assistance to service engineers for timely maintenance and smooth operation of product. 
* Customer will not/ shall not by itself and /or perform any manual service operations by itself and /or third party arrangements unless and until these third party 
 arrangements have been supplied by us. This will give company right to forfeit Warranty of the product without any notice.
* Customer reserves right to describe issues as expressively and as accurate as possible, we will try our best to identify those issues and supply you service as best 
 as possible for smooth running of the product. Any equipment attached by third party however will be need to be rectified by that third party itself.

SUB-Section 3 (Exclusions)
* This warranty shall not apply to normal maintenance/wearing parts.
* Electrical parts such as controllers, switches, contactors, indicators, relays or MCB all or part thereof is dependent on clean supply of electricity, prone to any over 
 voltage, under voltage, phase failure or loss leads to damage of these parts and are not covered under warranty.
* Motor is not governed by our warranty coverage and is exclusively available by manufacturer for which necessary documents will be provided by us for customer to 
 avail warranty for motor.
* Any damaged caused due to improper handling/ operation beyond rated capacity/ use of improper grade of lubricants/ running without oil/ inadequate level of oil/
  improper use including operation and after discovery of defective or worn out parts/ substitution of other parts not approved by us/ any alteration or repair or 
 service by unauthorized person, unless requested by us/ not following to instructions as per manual given to customer will not be covered under warranty. in such a 
 manner as in its judgment affects the product materially and adversely, Shall avoid this warranty.
* Warranty shall not be entertained in event of damage during transit from our supply to customer's location. For such incident we direct customer to provide their 
 own transportation medium and support with necessary insurance at their own cost.

SUB-Section 4 (Termination/ forfeit of warranty)
* This Warranty/ service contract shall terminate immediately in the event of following:
o Improper installation o Mishandling o Improper handling o Operations beyond rated capacity o Use of improper grade of lubricant o Running without lubricant
o Inadequate level of lubricant o Improper use of operation and after discovery of defective or worn out parts. o Substitute parts used in product not approved by us.
o Any alteration/ service carried our by self or third party not approved by us. o Not following instruction as per manual provided by us. o Damage during transit.
o Damage claim for excluded section parts. o Modification in product package without written permission from company.

SUB-Section 5 (Prices)
* All the prices mentioned here are  ex-supply/ showroom Gwalior.
*Company reserves right to modify prices as per its discretion.
* The company expressly reserves the right to increase the quoted price in the event of increased cost.
* Any alteration in quotation tends to increase or decrease price and thus increase in supply time.

SUB-Section 6 (Taxes)
* Taxes are not included in price mentioned in quotation and only included in Estimate/ Proforma Invoice or Tax Invoice.
* Subject to GST rate applicable to price which is Generally 18% of Basic amount, Which will be added at the time of proforma invoice/ tax invoice generation.
* If any additional tax is imposed on company including but not limited to additional cess, SEZ supply code, reverse charge for special category customer, the 
 customer agrees to pay the same and reimburse the company from such taxes or charges.
* As per updated guidelines my ministry of Micro, Small and Medium scale enterprise. we shall not be held responsible if any charges are levied by government 
 to buyer for making payment after more than 45 days as stipulated in circular issued in the Finance Act, 2023, introduced Section 43B (h) in the Income Tax Act 
 to ensure timely payments are made to MSMEs and to maintain uninterrupted cash flow.

SUB-Section 7(Order related changes by Customer)
* Any order related change requested by customer are subject to approval ( In writing) by the company and may result in increase in the price and /or a change in 
 delivery schedule.
